DreamScape Realty Statement of Contract and Sales

In consideration of becoming a DreamScape Islander with holdings, you need to know the following information. By making your first monthly PayPal payment for a parcel DreamScape Realty owns, you are entering a contract between yourself and DreamScape Realty. This contract is defined by the DreamScape I and DreamScape II Covenant, a separate document, you agree to the terms of, and this information below:

You do not have to be a basic or premium account holder in Second Life to purchase land here. You may have a free account and still be a landowner on DreamScape. You will own the parcel of land once it is purchased, however, you will be subject to the covenant that comes with the land by the Estate Owner (DreamScape Realty)

To buy the land, simply right click on the ground of the land for sale, and select BUY LAND from the pie menu. On the window you must agree to the covenant, and then purchase. You will be bound to this contract. This will send an automatic payment to the landowner and you will become the new landowner.

• ALL SALES OF LAND PARCELS ARE NOT FINAL UNTIL the Tier Subscription has been set up. Within 2 hours of buying your land you will need to set up your tier subscription. If you fail to set up Tier Subscription, or contact Venus Expedition in world or by e-mail to notify of an issue, your land will be reclaimed and no money will be refunded to you.

• You may not build on your land until Tier Subscription is set up with PayPal.

• All deals and sales are final once subscription payment is made. When you pay the monthly subscription for your parcel, you are entering a contract that runs for at least 30 days. This contract ends when this time period ends and no new monthly payment is made, or, when you decide to cancel the contract i.e. canceling your subscription or a cancellation of your subscription occurs.  To reinstate a cancelled contract, notify management and your subscription must be set up again within 24 hours of cancellation.

• The contract between yourself and DreamScape Realty terminates automatically (with no entitlement for a refund) if you violate the rules in this document, The DreamScape I or DreamScape II covenant or the Terms of Service of Second Life.

• When you enter the contract with DreamScape Realty, you agree to make certain periodic tier monthly payments. The amount of these payments is determined at the time you enter the contract and is fixed for the duration of the contract. DreamScape Realty reserves the right to change the amount of the payments at any time. You have the right to terminate your contract with DreamScape Realty in this case. No paid fees will be returned at the time of your cancellation.

• The current tier is always posted on our DreamScape blog. The duration of a contract is 30 days. It is subscription only via PayPal. It is automatically renewed each month if not canceled before the next payment is due. If you fail to cancel your subscription upon selling your land, you will not be refunded any money. The termination of the contract, either automatically or willfully before the next payment is due, does not entitle the customer to any kind of a refund. The termination of the contract at time of sale of land will not be complete until you cancel your PayPal subscription.

• The contract enters a state of probation, if complaints are lodged against you. This will be investigated by the DreamScape Team and a decision will be made. If a ban is warranted, you will be removed from the parcel, the land will be reclaimed and no money will be returned to you.

• The contract enters a state of probation, if you default on a monthly payment. It does not matter how much you pay as long as it is not enough to cover the full sum that is due for the next subscription period. You may not make regular PayPal payments (non-subscription payments) to cover your subscription failure unless approved by DreamScape Realty and has been invoiced to your e-mail. After entering the state of probation, you will receive notice on how to make the payment and what date the payment should be made and details about how to rectify this situation. If full payment is not received by the due date, the land is reclaimed by DreamScape Realty until the proper payment is made, in which we will require a re-deeding fee of 1500 Lindens if your land has been reclaimed.

• You have the right, to sell land that you bought on The DreamScape Islands to another resident. We will assist you in the transfer of your rights as an DreamScape Islander to this other resident if you need assistance. Selling of land is not possible if you are a renter. All negotiations with other residents regarding price and other proceedings are of no relevance to DreamScape Realty but we must have received the receipt from PayPal, confirming that the new owner has entered a subscription appropriate for this parcel before the deed of the land will be accepted.

• DreamScape Realty reserves the right to decline to enter a contract with any resident without stating a reason for this decision.

• DreamScape Realty does not make any guarantees regarding the state of the land offered to you or its usefulness for any intended purpose. We provide this land “AS IS” as it is delivered to us by Linden Lab.

• Should some officially announced, unannounced or unforeseeable event lead to a state where the sim(s) which contain the parcels that you have paid for, are inaccessible to you, we will see that access is restored as fast as possible. We can not accept any responsibility for times of inaccessibility caused by third parties. We will proceed with all due speed to remove the causes for the state of inaccessibility, should it be in our power to do so. There will be no refunds for times of inaccessibility. There will be no refunds due to loss of objects on the land in the event of a state of the sim performance or other unforseeable events.

RESELLING LAND

You may resell your parcel at your discretion after 48 hours period from buying your land, you must be the deeded land owner by evidence of paying and having setup the tier fees and resale the land according to the terms described here:

* Please advise the estate owner Venus Expedition via IM of your intent to sell if being done within a week of your land purchase. Otherwise it is not necessary to notify Estate Owner of intent to sell.
* All subsequent buyers are subject to the PURCHASE and TIER terms contained herein and not the tier fees the previous owner was paying. Please check the DreamScape website mentioned herein for current tier (www.dreamscapeislands.com)
* No prorated tiers or refunds for tiers are available if you resale. Please time your sales accordingly.
* Cancellation of tier fees with no notification of the estate owner will also result in land reclaim with no refund.

PRIVACY

Please preserve your neighbor’s privacy. No stalking, no spying or eavesdropping scripts. No harassing or stalking whether it is in covertly or overtly. If someone does not want you on their land, please respect this wish. It should not be necessary to ban you for that. If we get complaints we will investigate immediately and then take action that is appropriate, you may not like our decisions, however we will preserve the peace on the island at all costs. The same goes for people that are violating your rights as a land owner. Please log times and names of avatars and make abuse reports to Linden Labs immediately before contacting us. You can do that using your HELP feature at the top of your SL window.
We want all residents to enjoy their home, receive their guests and generally have a nice, fun and peaceful time.

If you have issues with harassment or avatars that are being abusive, please contact us so we can deal with those avatars immediately. We will deal with this behavior swiftly and strictly, and banning may be necessary and permanent.
